Motorcycle Fatality-Rush to Judgment?

A Port Vincent motorcyclist died early Friday after getting rear ended by a tractor-trailer he had pulled into the path of on U.S. 190 west of La. 1145 in West Baton Rouge Parish, Louisiana State Police announced in an email around 8:30 a.m.

 

The deceased, Joseph W. Landry, was 50 years old.

 

Troopers from Louisiana State Police Troop A began investiging the crash shortly after 12:15 a.m., making an intitial determination that Landry pulled out of the Cajun Circus parking on his 2004 Assm motorcycle and into the path of a westbound 2005 Freightliner tractor-trailer in the right hand lane.

 

Landry was wearing a helmet, but it was not an approved safety helmet, troopers said. Impairment on his part is not suspected, but troopers said they have submitted a toxicology sample from him to the Louisiana State Police Crime Lab for analysis.

 

The driver of the Freightliner, Andrew Spears, of Baton Rouge, was properly restrained and was uninjured in the crash. Impairment on his part is not suspected, troopers said.

 

Again, a motorcyclist fatally injured.  Again, police investigators jump to the conclusion the he was at fault.
