Battle Continues in Morgan Breslin Case

The battle continues in the Morgan Breslin case.  Breslin, the former USC standout defensive end/outside linebacker, filed suit in Federal Court in California seeking disability and loss of value payments under an insurance policy sold to him by Lloyds of London (Amtrust).  Breslin’s attorney, Bryan Fisher, filed the California suit after a trick play attempt by Lloyd’s.  In a mad dash to have this case heard under lax New Jersey law, Lloyds sued Breslin and served him with notice of the lawsuit on the day it denied is claim.  Fisher, a leading NCAA and NFL disability attorney, characterized the move as “unprecedented” and made in “bad faith”.   Currently, both the California case seeking payment under the policy and the New Jersey case seeking only a declaration as to coverage remain pending.  However, motions are pending in the New Jersey case which may result in that case being transferred to California.  Click here for more information on the New Jersey case.
